Legal terms and conditions for using the Fair Giveaways platform
1. Introduction
Welcome to Fair Giveaways ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website and services located at fairgiveaways.com (the "Service") operated by Fair Giveaways.
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Account Terms
Account Creation
You create an account by registering with email and password, or by connecting your Instagram, YouTube, or Facebook account through OAuth. You are responsible for maintaining the security of your account credentials.
Instagram Account Requirement: The Service is only compatible with public Instagram Professional Accounts (Business or Creator) linked to a Facebook Page. It does not support personal or private Instagram accounts.
Account Responsibility
You are responsible for all content posted and activity that occurs under your account. You must not use the Service for any illegal or unauthorized purpose.
Age Requirements
You must be at least 13 years old to use this Service. If you are under 18, you must have permission from a parent or guardian.
3. Subscriptions and Payments
Premium Plans
We offer premium subscription plans that provide access to advanced features and higher limits. By subscribing, you agree to pay the fees associated with your chosen plan.
One-Time Giveaway Upgrades
In addition to subscriptions, we offer one-time upgrade purchases that unlock premium features for a specific giveaway. One-time giveaway upgrades are non-refundable once the purchase is completed. The upgrade applies exclusively to the designated giveaway and does not transfer to other giveaways or your account in general.
Promotional Upgrades
From time to time, we may offer promotional upgrades for specific giveaways, such as offering premium features in exchange for including promotional text in your post caption. These offers are promotional and temporary in nature. We reserve the right to modify, disable, or remove these promotional offers at any time without prior notice. If the promotional text is removed or modified after the upgrade has been granted, we reserve the right to revoke the upgraded features, pause the giveaway, or require a paid upgrade to complete the giveaway process (such as drawing winners).
Billing and Cancellation
Subscriptions are billed in advance on a recurring basis (monthly or yearly). You can cancel your subscription at any time through your dashboard. Cancellation will take effect at the end of the current billing period.
Refunds
Subscription payments and one-time upgrade purchases are non-refundable unless required by applicable law. We do not provide refunds or credits for partial subscription periods or for one-time upgrades regardless of whether the giveaway has been completed, cancelled, or removed.
Feature Changes
We reserve the right to modify, add, or remove features included in any plan or one-time upgrade at any time without prior notice. While we strive to maintain and improve our Service, specific features are not guaranteed to remain available, function in a particular way, or perform without interruption. Your continued use of the Service following any feature changes constitutes your acceptance of such changes.
Payment Processing
We use Revolut Pay for secure payment processing. We do not store your complete payment information on our servers.
4. Giveaway Terms
Creator Responsibilities
As a giveaway creator, you are solely responsible for:
- Providing accurate giveaway descriptions and prizes
- Fulfilling prize delivery to winners
- Complying with all applicable laws and platform rules
- Obtaining necessary permissions for prize distribution
Participant Responsibilities
As a giveaway participant, you agree to:
- Follow the specific rules of each giveaway
- Provide accurate contact information if you win
- Not use automated tools or bots to enter giveaways
- Respect other participants and creators
Platform Role
Fair Giveaways provides the technology platform for provably fair winner selection. We are not responsible for prize fulfillment, which remains the creator's responsibility.
Content Standards and Removal
We reserve the right to review, remove, or restrict access to any giveaway or user-generated content on our platform at our sole discretion. In cases of improper content or violations of these Terms, we reserve the right to delete giveaways and permanently ban creators from the platform. This right applies regardless of whether the content was created using a free account, a premium subscription, or a one-time giveaway upgrade. No refunds or credits will be issued for subscriptions or one-time upgrades if your account is banned or your content is removed due to terms violations.
5. Prohibited Uses
You may not use our Service:
For any unlawful purpose or to solicit others to perform illegal acts
To attempt to manipulate giveaways or circumvent our fair selection process
To spam, harass, or abuse other users or the platform
To use bots, scripts, or other automated means to interact with the Service
To infringe upon or violate intellectual property rights of others
6. Privacy and Data Protection
Data Collection
We collect minimal data necessary to operate the Service, including OAuth tokens for platform integration (Instagram, YouTube, Facebook) and giveaway participation records. Please review our Privacy Policy for detailed information.
Data Usage
Your data is used solely to provide the Service and ensure fair giveaway operations. We do not sell your personal data to third parties.
Data Security
We implement industry-standard security measures to protect your data, including encryption and secure storage practices.
7. Intellectual Property
Our provably fair algorithms and verification systems are open source and available for public inspection, but the overall platform design and implementation remain our intellectual property.
8. Disclaimers
Service Availability
We strive to maintain high service availability but cannot guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind.
Feature Availability
Premium features, whether accessed through a subscription or a one-time giveaway upgrade, are provided on an "as is" and "as available" basis. We do not warrant that any specific feature will be available, uninterrupted, error-free, or function in any particular manner. We may modify, suspend, or discontinue any feature at any time without liability or obligation to provide a refund.
Third-Party Platforms
Our Service integrates with Instagram, YouTube, and Facebook. We are not responsible for changes to these platforms that may affect our Service functionality.
Specifically, for Instagram integration, please note that the Meta API only supports public Instagram Professional Accounts (Business or Creator) that are linked to a Facebook Page. Personal or private accounts are not supported by the Meta API and cannot be used with our Service.
Prize Fulfillment
We provide the technology for fair winner selection but are not responsible for prize fulfillment, which remains solely the creator's responsibility.
9. Limitation of Liability
In no event shall Fair Giveaways, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.
10. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
You may terminate your account at any time by disconnecting your social media accounts from our platform.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
